Terms of Service

I am aware that there is a possibility of injury or illness that exists by participating in physical fitness activities and exercise, and that such activity can also complicate pre-existing conditions. Such problems include, but are not limited to, heat related illnesses, abnormal heart beats, abnormal blood pressure, stroke and heart attack. I acknowledge and agree that my participation in fitness activities and exercise is completely voluntary, that I have been advised by Rory Lynch to consult with my physician prior to starting an exercise or fitness program or using any fitness equipment, and that I freely accept and fully assume all responsibility for all risks, and all possibilities of personal injury, death, property damage or loss to myself or any other person as a result of my participation in fitness activities. I therefore, for myself, my heirs, next of kin, executors, administrators and assignees agree:

1.       To release and forever discharge Rory Lynch from all liability for any personal injury, death, property damage or loss resulting from my participation in fitness activities due to any cause, including but not limited to negligence, breach of any duty imposed by law, or mistake in error of judgement of Rory Lynch; 

2.       To be liable for and to hold harmless and indemnify Rory Lynch from all actions, proceedings, claims, damages, costs demands, including court costs on a solicitor and own client basis, and liabilities of any nature or kind whatsoever arising out of or in any way connected with my participation in fitness activities;

3.       That I understand that by Rory Lynch providing and maintaining an exercise\fitness program with me does not constitute an acknowledgement, representation or indication of my physiological well-being or a medical opinion;

4.       That I understand that any exercises given by Rory Lynch or set out in any program or materials provided or recommended to me by Rory Lynch are intended to be undertaken while under the direct supervision of Rory Lynch, and that I accept all responsibility and liability for undertaking such exercises or programs while unsupervised; and

5.       That Rory Lynch is not liable or responsible for any damage to or loss of my property;
